Quick answer: As a mutual fund distributor (MFD), the commission you earn from AMCs is business income, taxed at your slab rate. File ITR-3, not ITR-4: the 8%/6% presumptive scheme under section 44AD does not apply to anyone earning commission or brokerage. Show your full commission, subtract genuine business expenses, and claim the TDS that AMCs cut at 2% under section 194H (it shows in Form 26AS and AIS). If your total tax for the year is ₹10,000 or more, pay advance tax in four instalments. For FY 2025-26, the ITR-3 due date was 31 August 2026 (21 November 2026 if your accounts are audited); if you missed it, file a belated return by 31 December 2026. Your own mutual fund gains go in the same ITR-3.

How is mutual fund distributor income taxed?
The trail and upfront commission you receive from AMCs is income from your own business. It falls under the head "Profits and gains of business or profession" and is added to your other income and taxed at your slab rate. There is no special rate for commission.
- ✓ Individual ARN holder: your commission is business income. This guide is for you.
- ✓ Employee with an EUIN (bank RM, staff of a distribution firm): you earn salary, not commission. You file ITR-1 or ITR-2 like any salaried person. See EUIN registration.
- ✓ Sub-broker or MFD on a platform: the commission share you get from the main distributor or platform is still your business income, and they deduct TDS on it.
- ✓ Partnership firm, LLP or company with an ARN: the entity files its own return (ITR-5 or ITR-6), usually with a CA.
Which ITR form should a mutual fund distributor file?
An individual MFD should file ITR-3. The Income Tax Department's guide for AY 2026-27 lists ITR-3 for individuals with business or profession income who are not eligible for ITR-1, ITR-2 or ITR-4.
| Form | Can an MFD use it? | Why |
|---|---|---|
| ITR-1 | No | Only for salary, one house, other sources and small equity LTCG; no business income |
| ITR-2 | No | Not for business income |
| ITR-3 | Yes | For business or profession income computed normally (income minus expenses) |
| ITR-4 | No | Only for presumptive income under 44AD/44ADA/44AE, which commission does not qualify for |
ITR-3 also covers your salary (if any), house property, your own mutual fund capital gains and interest, so you file one return for everything.
Can an MFD use presumptive taxation under section 44AD or 44ADA?
No. Section 44AD lets small businesses declare 8% of turnover (6% for digital receipts) as profit without detailed accounts. But section 44AD(6) says it does not apply to "a person earning income in the nature of commission or brokerage" or to anyone carrying on an agency business. The Income Tax Department's own FAQ gives insurance agents as an example of who cannot use it, for the same reason.
Section 44ADA (50% presumptive profit) is only for notified professions such as doctors, lawyers, CAs, engineers and architects. Mutual fund distribution is not one of them.
So you must compute your actual profit: gross commission minus real business expenses. Many MFDs wrongly file ITR-4 and get a defective-return notice.
TDS on mutual fund commission: section 194H
- ✓ Rate: 2% of commission (cut from 5% with effect from 1 October 2024).
- ✓ Threshold: TDS applies only if one payer pays you more than ₹20,000 in a financial year (raised from ₹15,000 with effect from 1 April 2025).
- ✓ Where to see it: Form 26AS and AIS on the e-filing portal, and the Form 16A each AMC or your platform issues every quarter.
- ✓ How to use it: TDS is not your final tax. Show the full commission as income and claim the TDS as credit. If your total tax is lower, you get a refund.
If the commission in your AMC statements doesn't match AIS (for example, one AMC reported under the wrong PAN), raise it with that AMC and give feedback on AIS before filing.
Documents an MFD needs for ITR filing
| Document | Where to get it | Use |
|---|---|---|
| Commission (brokerage) statements | Each AMC, CAMS and KFintech distributor services, or your platform | Gross commission for 1 April 2025 to 31 March 2026 |
| Form 26AS and AIS | Income tax e-filing portal | Commission reported by payers and TDS credit |
| Form 16A | Each AMC or your platform | Quarterly TDS certificates |
| Bank statements | Your bank | Match commission received; prove expenses |
| Expense bills and receipts | Your records | Rent, phone, travel, software, staff, ARN/NISM fees |
| GST returns (if registered) | GST portal | Turnover should match your ITR |
| Your own capital gains statement | CAMS and KFintech | If you redeemed your own mutual funds |
| Form 10-IEA acknowledgement | E-filing portal | Only if you opt for the old regime |
What expenses can a mutual fund distributor claim?
You can deduct expenses spent wholly and exclusively for your distribution business. Common ones:
- ✓ Office: rent, electricity and maintenance of your office (the business share, if you work from home).
- ✓ Communication: mobile, internet and SMS or email services used for clients.
- ✓ Travel: local travel and conveyance to meet clients.
- ✓ People: salary paid to staff or assistants.
- ✓ Tools: CRM, software and platform subscriptions, and depreciation on your laptop and office equipment.
- ✓ Regulatory: ARN registration and renewal fees, NISM exam and CPE fees.
- ✓ Marketing: investor awareness events, visiting cards, website and ads.
- ✓ Professional fees: CA and accounting fees.
Not allowed: personal or household spending, and any single business payment over ₹10,000 made in cash in a day. Keep bills for every claim.
Verify: Expense rules are in sections 30 to 37 and 40A of the Income-tax Act, 1961. We have not checked an official page for each expense listed above. Before claiming a large or unusual expense, check the Act on incometaxindia.gov.in or ask your CA.
Do MFDs need to maintain books of accounts or get a tax audit?
Tax audit (section 44AB): you need an audit only if your gross commission for the year is more than ₹1 crore, or more than ₹10 crore if your cash receipts and cash payments are each 5% or less of the total. Since AMCs pay commission by bank transfer, most MFDs fall under the ₹10 crore limit. If an audit applies, the CA files the audit report (Form 3CB-CD) and your ITR due date becomes 21 November 2026 for AY 2026-27.
Books of accounts (section 44AA): an individual in business must keep books if business income exceeds ₹2,50,000 or turnover exceeds ₹25,00,000 in any of the three preceding years. If you are below these limits, ITR-3 lets you fill the simpler "No accounts case" details in Part A-P&L instead of a full profit and loss account and balance sheet.
Verify: We could not open an official page that states the section 44AA limits of ₹2,50,000 and ₹25,00,000. Check section 44AA on incometaxindia.gov.in or with your CA. Even below the limit, keeping a simple income and expense register is good practice.
How to calculate income tax on MFD commission: two examples
Both examples are for FY 2025-26 under the default new regime. In the new regime, a business-income taxpayer gets no standard deduction.
| Item | Example 1 | Example 2 |
|---|---|---|
| Gross commission | ₹12,00,000 | ₹20,00,000 |
| TDS by AMCs at 2% | ₹24,000 | ₹40,000 |
| Less: business expenses | ₹2,00,000 | ₹2,00,000 |
| Taxable income | ₹10,00,000 | ₹18,00,000 |
| Tax as per slabs | ₹40,000 | ₹1,60,000 |
| Less: 87A rebate (income up to ₹12 lakh) | ₹40,000 | Not available |
| Add: 4% cess | Nil | ₹6,400 |
| Total tax | Nil | ₹1,66,400 |
| Result after TDS | Refund of ₹24,000 | Pay ₹1,26,400; advance tax was due |
New regime slabs for FY 2025-26: nil up to ₹4 lakh, 5% for ₹4–8 lakh, 10% for ₹8–12 lakh, 15% for ₹12–16 lakh, 20% for ₹16–20 lakh, 25% for ₹20–24 lakh and 30% above ₹24 lakh. Example 1 shows why even a small MFD should file: it is the only way to get TDS refunded.
Advance tax for mutual fund distributors
If your tax for the year, after TDS, is ₹10,000 or more, you must pay it in advance. Business income means even resident senior citizens are not exempt.
| Due date | Pay at least (cumulative) |
|---|---|
| 15 June | 15% of the year's tax |
| 15 September | 45% |
| 15 December | 75% |
| 15 March | 100% |
Miss or underpay an instalment and you pay interest under sections 234B and 234C. In Example 2 above, about ₹1.26 lakh should have been paid in instalments during the year. Pay through e-Pay Tax on the portal. Trail income is fairly steady, so estimating is easy: take last year's commission and adjust for your book growth.
Old or new tax regime for MFDs?
The new regime is the default. If you have business income and want the old regime (for 80C, 80D, home loan interest and so on), you must file Form 10-IEA on or before the ITR due date. Unlike salaried people, an MFD can switch back to the new regime only once in a lifetime, in a later year. Compare both regimes carefully before you opt out.
How to file ITR-3 as a mutual fund distributor: step by step
- Collect commission statements, Form 26AS, AIS, Form 16A, bank statements and expense bills for 1 April 2025 to 31 March 2026.
- Match total commission in your statements with AIS and 26AS. Fix gaps with the AMC or through AIS feedback.
- Log in to incometax.gov.in → e-File → Income Tax Returns → File Income Tax Return, choose AY 2026-27 and ITR-3.
- In the general information, choose your tax regime and enter Form 10-IEA details if you opted for the old regime.
- Fill Part A-P&L: either the full profit and loss account (if you keep books) or the "No accounts case" details (gross receipts, expenses, net profit). Choose the nature-of-business code that fits commission-based financial distribution.
- Check Schedule BP, which computes your business income from Part A-P&L.
- Add your own investments: Schedule CG and Schedule 112A for mutual fund or share sales, Schedule OS for interest and dividends.
- Check that the TDS schedule shows all the 194H TDS from Form 26AS.
- Review the tax computed. Pay any balance as self-assessment tax through e-Pay Tax and enter the challan.
- Submit and e-verify within 30 days. If you verify later, the verification date counts as the filing date.
Verify: The ITR business code list changes from time to time and we could not find an official code specific to mutual fund distribution. Pick the closest code from the drop-down in the ITR utility, or ask your CA.
GST and income tax: what MFDs must match
GST is a separate tax with its own returns; it is not filed in your ITR. Under the CGST Act, a service provider must register once aggregate turnover in a financial year crosses ₹20 lakh (₹10 lakh in special category states). If you are registered, your commission turnover in GST returns should match what you show in ITR-3 and what AIS shows. Mismatches are a common trigger for notices.

Your own mutual fund investments in the same ITR
If you sold or switched your own mutual fund units, report the gains in ITR-3 too. Rates for units sold in FY 2025-26:
| Fund type | Short-term | Long-term |
|---|---|---|
| Equity-oriented funds (65%+ in listed Indian shares) | Held ≤ 12 months: 20% | Held > 12 months: 12.5% on gains above ₹1.25 lakh |
| Funds with more than 65% in debt, bought on or after 1 April 2023 | Slab rate, any holding period | No long-term benefit |
| Debt funds bought before 1 April 2023; hybrid, gold and international funds | Held ≤ 24 months: slab rate | Held > 24 months: 12.5% (12 months for listed ETFs) |
Plus 4% cess. Download capital gains statements from both CAMS and KFintech. The 87A rebate does not cover these special-rate gains.
ITR due dates for MFDs, AY 2026-27
| Return | Last date | Note |
|---|---|---|
| ITR-3, accounts not audited | 31 August 2026 | Passed |
| ITR-3, accounts audited under 44AB | 21 November 2026 | Extended from 31 October by CBDT Circular 7/2026 |
| Belated return | 31 December 2026 | Late fee ₹5,000 (₹1,000 if income ≤ ₹5 lakh); business and capital losses can't be carried forward |
| Revised return | 31 March 2027 | Fee ₹1,000 (income ≤ ₹5 lakh) or ₹5,000 if revised after 31 December 2026 |
| Updated return (ITR-U) | Up to 48 months from end of the AY | Only to add income; extra 25% to 70% of tax and interest |
From 1 April 2026 the Income-tax Act, 2025 applies, and "tax year 2026-27" replaces FY/AY. Rates are unchanged; section numbers and forms will look different next year. Returns for FY 2025-26 are still filed under the 1961 Act.
Common ITR mistakes mutual fund distributors make
- Filing ITR-4 under 44AD. Commission income is excluded; use ITR-3.
- Showing commission net of TDS. Show the gross amount and claim TDS separately.
- Missing a payer. Commission from a smaller AMC or a platform is left out, and AIS flags it.
- Filing ITR-1 or ITR-2 because you also have a salary. Any business income means ITR-3.
- Skipping advance tax because TDS is cut. 2% TDS rarely covers the full tax once commission grows.
- Claiming personal expenses or expenses without bills.
- GST and ITR turnover not matching.
- Not e-verifying within 30 days.
What we checked, and what you should verify
This guide was checked on 30 October 2026 against the official sources listed below: Finance Bill memoranda, the Budget 2026-27 speech, incometax.gov.in help pages, the ITR-3 validation rules for AY 2026-27, CBDT Circular 7/2026 and the CGST Act.
Three points are general rules we could not confirm on an official web page, and are marked "Verify" above: the section 44AA book-keeping limits, the list of deductible expenses, and the ITR business code for mutual fund distribution. Check them on incometaxindia.gov.in or with a chartered accountant.
The revised-return date of 31 March 2027 and its fee are shown on incometax.gov.in as "proposed in the Finance Bill, 2026". Recheck on the portal before relying on them.
